David's Death Penalty Resources; Process: Appeals begin
automatically in State Appeals Courts, and are limited to evidentiary issues that came up
during trial. Most State Appeals Courts affirm convictions and State Supreme Courts
usually decline to review. Next, the inmate files a state habeas corpus lawsuit in a State
Appeals Court, this time raising issues that did not come up during trial, such as newly
discovered evidence or charges of prosecutorial misconduct. If the Appeals Court declines
to hear this, the inmate looks again to the State Supreme Court, who usually decline to
review. Next, comes the federal habeas corpus stage, beginning in a local U.S. District
Court, where all the issues are reargued, evidentiary and habeas corpus. If a federal
judge rejects the arguments, the inmate turns to the nearest U.S. Court of Appeals, and if
no relief is obtained there, a petition is filed with the U.S. Supreme Court, asking to be
heard, and these Justices only accept a small fraction of cases, only those involving
constitutional law principles, but last-minute temporary reprieves (or stays of execution)

Rodney King while they were being secretly videotaped by a spectator and their racial
