(AS BEFORE) Instructions: For each of the following scenarios, read the details of the case, which include the case description in the docket file and the presentence investigation, as well as look at the defendant as they read or do not read their statement. Then, use the sentencing guidelines provided with each scenario to render your decision. DO NOT just render your decision. This assignment is NOT over once you have decided upon a sentence. You must also do some writing about (1) what aspect of the case weighed more heavily in your mind while rendering your decision; and (2) how satisfied you "feel" about the justice or fairness of the sentence you have rendered.

Defendant #2:

Jane Maloy, a 33 year old African American female, was charged and convicted of one count of armed robbery and count of assault and battery.

Background: Around 2:30 p.m. on the afternoon of September 18, the victim, a Mr. Joe Green, was assaulted and robbed of his wallet by the defendant while walking home from work. Mr. Green was assaulted, pushed up against his car, and threatened with a knife.  The defendant was apprehended a short time later while carrying Mr. Green's wallet and a knife.  Mr. Greene subsequently identified the defendant in a lineup.

Sentencing Guidelines: If the defendant is convicted of more than one charge, the sentences can run either consecutively or concurrently, as the judge deems appropriate. Thus, multiple charges can be served one after another or all at the same time. Community service, restitution, psychological counseling, and/or alternative sentences may be imposed as a special condition of probation, if the judge decides on probation. The range of permissible sentence for each count of Armed Robbery is 2-10 years with a fine not  to exceed $10,000. The range of permissible sentence for each count of Assault and Battery is 1-2 years.

Presentence Investigation Report: Jane Maloy is married with two children who has lived in a rented house for four years. She is a high school graduate. She has no known health problems, but there is a history of mental health problems. There is no history of drug abuse, but is a frequent user of alcohol.. She is a self-employed carpenter, and drives a 1997 Chevrolet Cavalier. Her credit history indicates a credit card debt of approximately $35,000. She has no prior criminal record.
